Policy for Online Purchases of Products and Registration for Activities
1. General
1.1. The Website Owner offers a wide range of handmade printed textile products, screen-printing equipment, and kits for sale on the website, as detailed and updated from time to time. Purchasing these products via the website (hereinafter: the "Purchase", "Transaction", or "Order") is subject to the policies detailed below (hereinafter: the "Policy"), which forms the legally binding contract between the Website Owner and the purchaser (hereinafter: the "Customer" or "You").
1.2. Completing the purchase process and payment at checkout constitutes your confirmation that you have read this Policy and agree to its terms.
1.3. The Website Owner reserves the right to amend this Policy occasionally at their sole discretion. Any changes will be binding immediately upon implementation.
1.4. In the event of a contradiction and/or discrepancy between this Policy and any other publication, the provisions of this Policy shall prevail.
1.5. The subheadings in this Policy are for convenience only and hold no interpretive weight.
1.6. While initially drafted in the feminine form (in the original language), this Policy applies equally to all genders.
1.7. If you do not agree to the terms specified below, please refrain from completing the purchase process.
2. Purchasing Physical Products
2.1. Purchasing on the website is available to anyone with the legal capacity to do so under their applicable jurisdiction and who owns a valid email address.
2.2. If you are under the legal age of adulthood in your jurisdiction (e.g., under 18 in most EU countries) or require third-party approval for legal actions, you declare that you have obtained the consent of your parents/guardians to make the purchase.
2.3. In the online store, you may view product specifications, colors, sizes, and prices per unit. You can adjust quantities, add, or remove items from the cart until checkout is finalized.
2.4. Please note: The system's receipt of order details does not constitute an obligation by the Website Owner to supply the items, but merely confirms the order is being processed.
2.5. Supply is subject to stock availability. If stock is unavailable, the Customer will be notified, and no charges will apply (or a full refund will be issued).
2.6. The Website Owner may set minimum purchase amounts or limit the quantity per product.
2.7. Prices are displayed in the applicable currency (e.g., ILS in Hebrew, USD/EUR in English). The final checkout price includes the product price and applicable shipping fees.
2.8. The Website Owner reserves the right to change prices, launch promotions, or discontinue them at any time without prior notice.
2.9. Payment must be made fully in advance via:
Valid credit/debit card processed securely under PCI compliance. Credit card details are never saved on our servers.
Bank transfer (using provided details).
PayPal, subject to their terms of use.
2.10. Completion of the transaction is contingent upon the payment provider's approval.
2.11. Upon completion, an email confirmation will be sent. If not received, please contact us immediately. Processing time for in-stock items is up to one (1) business day prior to shipment.
3. Delivery and Shipping
3.1. Deliveries are made via our designated courier service (e.g., HFD) or via local pickup by prior arrangement.
3.2. Shipping fees may vary based on the destination and delivery method. For EU customers, any applicable import duties or taxes are the sole responsibility of the Customer unless explicitly stated otherwise.
3.3. The Customer is responsible for providing an accurate delivery address. If products are returned due to incorrect details or failure to collect the package, the Customer may be charged for return shipping costs.
3.4. Risk of Loss: For EU consumers, the risk of loss or damage to the goods passes to the Customer only when the Customer (or a designated third party other than the carrier) has acquired physical possession of the goods.
3.5. The Website Owner is not liable for shipping delays caused by events beyond their control (Force Majeure, strikes, customs delays, extreme weather). In such cases, if the delay is unreasonable, the Customer may cancel the order for a full refund.
4. Right of Withdrawal, Cancellations, and Returns (EU Adapted)
4.1. EU Right of Withdrawal: If you reside in the EU, you have the right to withdraw from this contract within fourteen (14) days without giving any reason. The withdrawal period will expire 14 days from the day you acquire physical possession of the goods.
4.2. How to Withdraw: To exercise this right, you must inform us of your decision by an unequivocal written statement (e.g., via email).
4.3. Effects of Withdrawal: If you withdraw from this contract, we shall reimburse all payments received from you, including standard delivery costs, without undue delay and no later than 14 days from the day we are informed of your decision. We may withhold reimbursement until we have received the goods back or you have supplied evidence of returning them.
4.4. Return Shipping Costs: You will have to bear the direct cost of returning the goods.
4.5. Condition of Goods: You are only liable for any diminished value of the goods resulting from the handling other than what is necessary to establish the nature, characteristics, and functioning of the goods. Goods should ideally be returned in their original packaging.
4.6. Exceptions: The Right of Withdrawal does not apply to the supply of goods made to the consumer's specifications or clearly personalized (e.g., custom-printed textiles).
4.7. Defective Items: If you receive a defective or incorrect item, please notify us immediately with photographic evidence. We will provide a full refund or replacement, and we will cover the return shipping costs.
Note on Original Policy: The original deduction of a 5% or 100 NIS cancellation fee is void for EU consumers exercising their 14-day Right of Withdrawal, as EU law mandates full refunds.
5. Legal Guarantee and Warranty
5.1. Visual Representation: Product images are for illustrative purposes. Slight variations in color and texture may occur between digital screens and the physical product.
5.2. EU Legal Guarantee: In accordance with EU Directive 2019/771, EU consumers are entitled to a two-year mandatory legal guarantee of conformity for goods. If a product turns out to be faulty or does not look or work as advertised, the consumer has the right to have it repaired, replaced, or, if neither is possible, to a price reduction or a full refund.
5.3. Exclusions: This guarantee does not cover defects arising from improper use, normal wear and tear, accidents, neglect, or failure to follow care instructions (e.g., washing inside out, low temperature, no wringing).
5.4. The products are intended for personal use, not for commercial resale.
6. Registration and Participation in Activities (Workshops)
6.1. Registration for physical or online activities is subject to these terms. Specific conditions may apply to certain activities and will be detailed on the registration page.
6.2. Minors may participate, subject to prior consultation with the instructor to ensure suitability. Registration must be made by a parent/guardian.
6.3. Activities are contingent on a minimum number of participants (usually 2). If not met, the activity may be canceled (with a full refund) or postponed.
6.4. Maximum capacity is typically capped (e.g., 6 participants). Registration is on a first-come, first-served basis.
7. Cancellation of Activities and Refunds
7.1. Exemptions under EU Law: Under Article 16(l) of the EU Consumer Rights Directive, the 14-day Right of Withdrawal does not apply to the provision of leisure activities if the contract provides for a specific date or period of performance. Therefore, our standard cancellation policy applies:
7.2. Cancellation by the Instructor: If we cancel the activity, participants will receive a full refund. If an in-person event must be moved online due to unforeseen circumstances, refunds/rescheduling options will be provided.
7.3. Cancellation by the Participant:
Cancellations made up to two (2) business days before the activity will receive a full refund, minus any applicable payment processing fees (if permitted by local law).
Cancellations made less than two (2) business days prior will not be eligible for a refund.
8. Intellectual Property and Marketing
8.1. Copyright: The tools, knowledge, techniques, and materials provided in workshops are for personal use only. The Instructor holds all intellectual property rights to the activity content.
8.2. Liability in Workshops: Activities are conducted based on the Instructor's professional experience. Participants act upon the taught content at their own risk. No specific commercial outcomes are guaranteed.
8.3. Photography: Photos may be taken during workshops for marketing purposes. Participants who do not wish to be photographed must explicitly state this beforehand.
8.4. Direct Marketing (GDPR Compliance): We will only send you marketing emails, newsletters, or promotional content if you have explicitly opted in to receive them. You may easily withdraw your consent and unsubscribe at any time using the link at the bottom of our emails.
9. Jurisdiction and Applicable Law
9.1. This Policy is governed by the laws of the State of Israel.
9.2. EU Consumer Protection: However, if you are a consumer residing in the European Union, this choice of law does not deprive you of the protection granted to you by mandatory consumer protection provisions of the country in which you have your habitual residence.
9.3. Dispute Resolution: While the courts of Haifa, Israel, have jurisdiction, an EU consumer may also bring proceedings against the Website Owner in the courts of the Member State in which the consumer is domiciled.
9.4. Statute of Limitations: The 6-month limitation period originally stated in Israeli terms does not apply to EU consumers; standard statutory limitation periods of your residing Member State will apply (e.g., minimum 2 years for goods conformity).
10. Privacy and Data Protection (GDPR Compliant)
10.1. Data Controller: The Website Owner acts as the Data Controller for the personal data collected through this site, operating in compliance with the EU General Data Protection Regulation (GDPR) and the Israeli Privacy Protection Law.
10.2. Data Collection: We collect necessary personal data (name, address, email, phone number) purely on the lawful basis of contractual necessity (to fulfill your order) and consent (for marketing).
10.3. Data Usage: Your data is used exclusively to:
